NEGLIGENCE

Negligence is most generally an act or the failure to act by an individual, business or government entity which has a duty to do so which fails to rise to the level of what a reasonably prudent individual would or would not do under similar circumstances. To be actionable, such a negligent act or failure to act typically must cause harm to a person or damage to property.

We all know of instances in which a person suffered injury or property was damaged because of the negligent act of another. Unfortunately, negligence occurs all too frequently with results often catastrophic to those involved. A motor vehicle accident leading to serious injury or death, a construction or home accident caused by a defective product, a child injured at a day care center because supervising personnel were not paying proper attention, or an elder American ignored, mistreated or abused in a nursing home or adult care center, are all acts which simply should not happen, but which do on a daily basis.

Whether in your view the negligent act was minor, ordinary or great, if you suffered an injury to person or property, you may be entitled to substantial money damages.
